I think you can just let Buffalo processing center about your spouse details. you might have to fillup some forms. My advice is to add your spouse before approval. I think after approval, you have to apply for canadian PR for your wife separately as a "family" class and for that I think you need to stay in canada to show a canadian adress (I am not sure though). I have one friend who is a canadian citizen did the same think for his wife. It took only 6 months from buffalo center...

does it also take years to add spouse (like US GC) if i marry after my PR gets approved..???

Hi Gurus,
1) Is it possible to have 2 different I-485 with 2 different employers at the same time?

I already have an EB3 I-485 pending through my current employer. I have EB2, I-140 approval with future employer,

2) Is it possible to file second EB2 I-485 through my future employer?

3) If file second 485, what will be affect on pending I-485?

Another front to think about :

Recently I have heard that when the company publishes advertisement for the labor when filling for fresh PERM, every time there is a response coming back because of the higher rate of unemployment in the market. The issue is, if any response comes back then the company cannot proceed with the labor and new GC process gets hung.

So, to be on safer side just check on ur skill set before resigning the current job as it should not be readily available in the market.

Go for it! She can volunteer (obviously, she cannot get paid for the work she will do). I think it is a great idea to volunteer to establish connections and gain work experience to get ready for a real job.

My wife did the same thing when she was on H-4 and HR had no issues with that.

However, last year USCIS and lawyers association had a lengthy debate about the legal -wordings, over this issue and i have no idea what happened afterwards

How did you find out the status of your namecheck and FP?

I called up their customer service no and was able to reach an IO at TSC and asked about the FBI name check status. I did speak to an IO 3 to 4 times over a period of 6 months and initially it was pending but later on it got cleared. I did not ask for the exact date it was cleared but it was on feb1st 2008 that I found that it was cleared. But they did tell me the exact date on which the FBI name check was initiated. It was initiated on Aug 1st 2007 where are my 485 RD is June21st 2007.

My immigration status is H1 (485 pending EB2/INDIA). I am on the verge of completing my 2 year Masters in Computer Information Systems (MS-CIS) from Missouri State in Springfield, Missouri. Its a distance education Masters program with one week of on-campus residency every semester. The program is geared towards working IT professionals and its accredited by AACSB. That is correct. Mixing and matching with certifications doesn't work. Although I don't know about CPA, if it goes towards professional degree.

Hey there, I have a three year bachelor's (from Australia) and an American CPA. I believe the two can be evaluated to an Ameircan Master's equivalent. Please, check with your lawyers. It should be possible.

I-140 and I-485 are always for future employment. Current employment only assures that employer has future permanent employment on your GC approval (employment on H1 is supposed to be temporary). There is nothing to stop you from working anywhere (or not working at all) until you get GC, at which time sponsoring employer is obligated to give you a job (for which he got LC and I-140 approved), and you are obligated to work for him. If AOS is not approved within 180 days, AC21 can be applied leaving no obligation to work for sponsoring employer.

BTW, I-140 is an employer filing. They are expected to pay for it. Since July 07 it is illegal for employers to ask employees to pay immigration related fees (or ask to fill a bond to work for certain period).

You may not use AC-21 AOS portability for future employment green cards. This is because the start date of employment on your AC-21 letter(from I assume your current employer) should be 180 days after filing of your future employment 485. Since you have been working for your current employer prior to that - USCIS will deny your 485

The problem is not the hours I worked as I've always worked legally and within the laws of the University and visa status.

The problem is proving that I filed my taxes, which I did but I can't produce evidence and neither can the IRS.

I understand your problem. All I was saying is to make sure any response you provide includes that your work during 1999-2000 was legal as per F1 on-campus regulations. And I hope the attorney you hire should be able to do that. If you do not have Tax returns , then you don't. Like someone said earlier , your W2 along with IRS letter that they do not keep records older than 7 years maybe enough but again your attorney should make this decision wisely.

I fully believe in court systems in USA, and feel that we should file the lawsuit. The bills like CIR or SKIL wont see the daylight in political fights
